Services Provided

Trajectory Media LLC is a marketing and creative production agency providing services primarily to e-commerce and direct-to-consumer (DTC) businesses, including creative strategy, ad creative production, conversion rate optimization (CRO), sales funnel development, and paid advertising setup and management.

Our services may include, but are not limited to:

  • Creative strategy and creative direction
  • Ad creative production (static, video, and UGC-style content)
  • Conversion rate optimization (CRO)
  • Sales funnel design and development
  • Landing page and website development
  • Meta (Facebook & Instagram) ads setup, account structure, and management
  • Paid advertising setup and campaign structure across third-party platforms
  • AI-assisted creative and content production
  • Reporting and ongoing support

The exact scope of services will be agreed separately with each client through a written proposal, service agreement, invoice, or order confirmation.

Eligibility

By using our services, you confirm that:

  • you are at least 18 years old;
  • you are legally able to enter into a business agreement;
  • all information you provide to us is accurate and complete;
  • you will use our services only for lawful business purposes.

We reserve the right to refuse service to any individual or business that we believe may be involved in unlawful, misleading, harmful, or high-risk activities.

Client Responsibilities

Clients are responsible for providing accurate information, content, access, approvals, and any materials required for the delivery of services.

This may include, but is not limited to:

  • business information;
  • branding materials, product information, and assets;
  • website, store, and content access;
  • access to advertising accounts, CRM, analytics, or other third-party platforms;
  • timely feedback and approvals;
  • payment of agreed fees.

Delays in providing required information, access, or approvals may delay the delivery of the services.

Payments and Billing

Fees for services will be clearly communicated before work begins.

Payments may include:

  • monthly retainer or subscription fees;
  • one-time setup fees;
  • project-based fees;
  • ongoing support fees;
  • advertising management fees;
  • custom service fees.

Unless otherwise stated, all fees are payable in advance.

Monthly retainers and subscriptions are billed on a recurring basis until cancelled in accordance with our cancellation terms.

Clients are responsible for ensuring that payment details are accurate and up to date. Advertising spend (ad budget) paid directly to advertising platforms is separate from, and additional to, our management fees, unless otherwise agreed in writing.

Setup Fees

Some services may require a one-time setup fee depending on the project scope, level of customization, integrations, and implementation work required.

Setup fees are non-refundable once work has started, unless otherwise agreed in writing.

Subscriptions and Cancellation

Monthly services may be cancelled according to the terms agreed in the client's proposal, invoice, or service agreement.

Unless otherwise stated, clients may cancel their monthly service before the next billing cycle by contacting us at contact@trajectorymedia.co.

Cancellation requests must be submitted before the next renewal date to avoid being charged for the following billing period.

Fees already paid for the current billing period are generally non-refundable, except where required by law or agreed in writing.

Refund Policy

Refunds are handled according to our Refund & Cancellation Policy. In general:

  • setup fees are non-refundable once work has started;
  • completed work is non-refundable;
  • monthly retainer and subscription fees are billed in advance;
  • no refund is provided for services already delivered or partially delivered;
  • refund requests must be submitted by email to contact@trajectorymedia.co.

Nothing in these Terms affects any legal rights you may have under applicable law.

No Guaranteed Results

Trajectory Media LLC provides creative, strategy, systems, funnels, websites, and paid advertising support designed to help businesses improve their marketing, conversion, and digital operations.

However, we do not guarantee specific sales, revenue, profits, return on ad spend (ROAS), advertising results, lead volume, conversion rates, or business outcomes.

Results may vary depending on factors such as the client's offer, product, market, pricing, sales process, advertising budget, creative approval decisions, customer follow-up, competition, and overall business operations.

Digital Advertising Services

Where digital advertising services are provided, clients understand that advertising platforms such as Meta, Google, TikTok, LinkedIn, or other third-party platforms are controlled by independent companies.

We are not responsible for:

  • ad account restrictions;
  • ad disapprovals;
  • platform policy changes;
  • changes in advertising costs;
  • changes in campaign performance;
  • suspension or limitation of third-party accounts;
  • decisions made by advertising platforms.

Clients remain responsible for complying with the policies of any third-party advertising platforms used, and for the advertising budget spent on those platforms.

Third-Party Platforms and Tools

Our services may involve third-party platforms, tools, or software providers, including but not limited to advertising platforms, e-commerce platforms, CRM platforms, payment processors, website builders, hosting providers, analytics tools, and communication tools.

We are not responsible for the availability, performance, pricing, errors, downtime, policy changes, or decisions of third-party providers.

Clients may be required to maintain active subscriptions or accounts with third-party providers in order to use certain services.

Intellectual Property

Unless otherwise agreed in writing, Trajectory Media LLC retains ownership of its internal processes, templates, frameworks, strategies, workflows, documentation, and proprietary methods.

Clients retain ownership of their own brand assets, logos, products, content, business information, and materials provided to us.

Upon full payment, clients may receive usage rights to the final deliverables created specifically for them, such as ad creatives, website pages, landing pages, funnels, written content, automations, or campaign structures, subject to any third-party platform or stock-media licensing limitations. We may display non-confidential deliverables and results in our portfolio and marketing materials unless otherwise agreed in writing.

Website, Creative, and Content Delivery

For website, landing page, funnel, or creative production projects, delivery timelines depend on the project scope and the client's ability to provide required content, feedback, and approvals.

We may use placeholder content, stock visuals, or AI-assisted drafts during the development process. Clients are responsible for reviewing and approving final content before publication or use in advertising.

Client Content and Compliance

Clients are responsible for ensuring that all content, claims, offers, products, services, images, testimonials, and business information provided to us are accurate, lawful, and compliant with applicable regulations.

We may refuse to publish or promote content that we believe is misleading, unlawful, harmful, or non-compliant with platform policies or applicable laws.

Data Protection and Privacy

We process personal data in accordance with our Privacy Policy.

Clients must ensure that they have the necessary rights, permissions, and lawful basis to provide us with any personal data, customer data, lead data, or business data required for the services.

Confidentiality

Both parties agree to keep confidential any non-public business, technical, financial, customer, or operational information shared during the course of the business relationship.

Confidential information must not be disclosed to third parties unless required by law or necessary for the delivery of the agreed services.

Limitation of Liability

To the maximum extent permitted by law, Trajectory Media LLC shall not be liable for indirect, incidental, special, consequential, or loss-of-profit damages arising from the use of our services.

Our total liability for any claim related to our services shall not exceed the amount paid by the client to Trajectory Media LLC for the specific service giving rise to the claim during the three months preceding the claim.

Nothing in these Terms limits liability where it cannot be limited under applicable law.

Service Availability

We aim to provide reliable and professional services, but we do not guarantee uninterrupted access to websites, systems, automations, third-party platforms, or communication tools.

Temporary interruptions may occur due to maintenance, updates, technical issues, third-party downtime, or circumstances outside our control.

Termination

We reserve the right to suspend or terminate services if:

  • payment is not received;
  • the client breaches these Terms;
  • the client provides false or misleading information;
  • the client uses our services for unlawful or harmful purposes;
  • continuing the service may create legal, financial, compliance, or reputational risk.

Governing Law

These Terms & Conditions are governed by the laws of the State of Wyoming, United States.

Any disputes shall be subject to the jurisdiction of the state and federal courts located in Wyoming, unless otherwise required by applicable law.

Changes to These Terms

We may update these Terms & Conditions from time to time.

The latest version will always be available on our website. Continued use of our website or services after changes are published means you accept the updated Terms.
